GAP Statement Regarding Gary Aguirre Case

Last Friday, July 14, Gary Aguirre filed a federal lawsuit against the Securities and Exchange Commission (SEC) under the Freedom of Information Act (FOIA) and the Privacy act seeking three categories of records – all relating to his recent testimony before the Senate Judiciary Committee. The first category seeks records such as transcripts of testimony, internal emails, and correspondence relating to the SEC decision to halt an insider trading investigation Aguirre led.

Gary Aguirre To Testify Before Senate Judiciary Committee Tomorrow

Gary Aguirre, a client of GAP Attorney Joanne Royce, will testify tomorrow, Wednesday, June 28, before the U.S. Senate Committee on the Judiciary. 

The hearing is entitled “Hedge Funds and Analysts: How Independent is their Relationship?” It is scheduled to begin at 9:30 a.m. in room 226 of the Dirksen Senate Office Building. 

GAP Releases DOE Plan to Dissolve Office of Environment, Safety and Health

The Government Accountability Project (GAP) has released a controversial Department of Energy (DOE) plan that proposes dissolving the Office of Environment, Safety and Health (ESH) and eliminating that office’s Assistant Secretary. This plan proposes to merge part of ESH with another DOE Office overseeing security, while dispersing the rest of the ESH functions over five other offices.

In a front-page article in today’s New York Times, Gary Aguirre, a client of GAP Attorney Joanne Royce, was identified as the S.E.C. lawyer who ran an investigation of Pequot Capital Management, a major hedge fund, until last summer.

Numerous groups are questioning the Department of Energy’s (DOE) plan to dismantle its Office of Environment, Safety & Health (ES&H). The safety and health responsibilities of that office would be transferred to another office that deals mostly with security and eliminate senior leadership provided by an Assistant Secretary. The Secretary of Energy embraced the concept at an all hands meeting last week, but DOE is refusing to release details or a rationale.

Drug Data Verified as False; North American Speaking Trip Underway

Washington, D.C. – Under pressure from Government Accountability Project (GAP) client Dr. Audrey Blumsohn, Proctor & Gamble finally (P&G) released the full research data set for its osteoporosis drug Actonel. Blumsohn had sought these data for four years. As Blumsohn anticipated, the data fail to support P&G’s claim that Actonel is as effective as industry leaders in treating osteoporosis.

Washington, DC – Today, the Supreme Court severely limited the rights of government employee whistleblowers to protect the public interest. Through its ruling in Garcetti v. Ceballos, the Court holds that government employees’ job-related speech is not protected by the first amendment, a significant departure from prior law.
